General Hotel Contractual Terms and Conditions (GTC)
- General provisions
1.1. These General Hotel Contractual Terms and Conditions (hereinafter referred to as GTC) summarize the contractual content under which Tornácos Szállás Kft. – as the operator of Somogy Kertje Üdülőfalu és Étterem – (7281 Bonnya, Kossuth Lajos u. 82/a.), hereinafter referred to as the Service Provider (or Holiday Village), generally enters into accommodation contracts with its Guests.
1.2. Individual conditions are not part of these GTC, but they do not exclude the conclusion of separate, special agreements with travel agents, organizers, sometimes with different conditions appropriate for the specific business.
- Contracting Parties
2.1. The services provided by the Service Provider are utilized by the Guest. If the Guest places the order for services directly with the Service Provider, then the Guest will be the Contracting Party. The Service Provider and the Guest together, if the conditions are met, become contractual parties (hereinafter: Parties).
2.2. If a third party (hereinafter referred to as the Intermediary) places the order for services on behalf of the Guest with the Service Provider, the terms of cooperation are governed by the agreement between the Service Provider and the Intermediary. In this case, the Service Provider is not obliged to verify whether the third party lawfully represents the Guest.
- Method and Conditions of Service Use
3.1. Upon a verbal or written inquiry from the Guest, the Service Provider will always send a written offer. If no specific order is received within 48 hours of sending the offer, the Service Provider’s offer commitment ceases.
3.2. The Contract is concluded solely by the Service Provider’s written confirmation of the Guest’s written booking, and thus qualifies as a written contract. The order must contain the Guest’s name, address, exact dates of arrival and departure, room type, and the precise description of the services (meals, programs). The Service Provider confirms orders in writing (e-mail).
3.3. Verbal bookings, agreements, modifications, or verbal confirmations by the Service Provider are not considered contractual.
3.4. The Contract for accommodation services is for a specified period. The offers of Somogy Kertje Üdülőfalu és Étterem – with the exception of Daily Room Rates – are available to Guests with a limited room capacity. The current list of mediated services available at Somogy Kertje Üdülőfalu és Étterem can be found on the website of Somogy Kertje Üdülőfalu és Étterem: www.somogykertje.hu.
3.5. If the Guest permanently leaves the room before the specified period expires, the Service Provider is entitled to the full value of the service stipulated in the Contract. The Service Provider is entitled to re-sell the room vacated before the expiration date.
3.6. The extension of accommodation services initiated by the Guest requires the prior consent of the Service Provider. In this case, the Service Provider may stipulate the reimbursement of the fee for services already rendered.
3.7. A condition for using accommodation services is that Guests verify their identity in accordance with legal regulations before occupying the room. No one may reside in the hotel without registration.
3.8. Any modification and/or addition to the Contract requires a written agreement signed by both Parties.
Commencement and End of Accommodation /check-in; check-out/
4.1. The Guest has the right to occupy the booked rooms from 14.00 on the agreed day.
4.2. The Service Provider has the right to withdraw from the contract if the Guest does not arrive by 18.00 on the agreed day, unless a later arrival time has been agreed upon and the booking has a guaranteed status (e.g., credit card guarantee).
4.3. If the Guest has paid a deposit, the room(s) will remain reserved until 12.00 on the following day at the latest.
4.4. The Guest must vacate the room by 10.00 on the day of departure.
4.5. Depending on the Service Provider’s occupancy, early check-in and late check-out options are available for a fee.
Extension of Accommodation
5.1. Any extension of the stay by the Guest requires the prior consent of the Service Provider.
5.2. If the Guest does not vacate their room by 10.00 on the day indicated as the departure day at check-in, and the Service Provider has not given prior consent for an extension of stay, the Service Provider is entitled to charge the room rate for an additional day, and simultaneously, the Service Provider’s service obligation ceases.
Prices
6.1. Prices – based on Section 6 of Government Decree 4/2009 (I.30) NFGM-SZMM – are displayed in a legally compliant manner at the place where the service is provided. The Guest can also receive adequate information about the service fee at the reception of Somogy Kertje Üdülőfalu és Étterem before the commencement of the service.
6.2. The Service Provider may change its advertised prices without prior notice (for example: due to package rates or other discounts). The Service Provider’s current prices can be found on the hotel’s website (www.somogykertje.hu).
6.2.1. The Service Provider does not provide a price guarantee in cases of invalid, erroneous, incorrect, or incomplete offers made to the Guest by a third party, nor in cases where the Service Provider does not have a valid contract with the third party.
6.3. The Guest can always receive information about the prices of services at the Service Provider’s reception before the commencement of the service.
6.4. The prices published by the Service Provider include the statutory VAT (unless otherwise indicated), but do not include the tourist tax, which must be paid on-site. The Service Provider will pass on additional burdens due to changes in the current tax law (VAT, Tourist Tax) to the Contracting Party, with prior notification.
6.5. Deposits:
For hotel guests, we request a minimum of 50% of the accommodation fee, and for a one-night stay, the price of 1 room night. The deposit is considered a booking guarantee. Bookings secured with a deposit can be modified in terms of date, subject to our available capacity, provided that the request is communicated to us in writing before the arrival date, according to the penalty policy stated in the specific package offer.
6.5.1. In case of Non-Refundable rates
If the Guest chooses a Non-Refundable rate during booking, the booking becomes final only upon the advance payment of 100% of the total accommodation fee. In this case, the amount paid is not considered a deposit or booking guarantee, but the full value of the service.
By choosing a Non-Refundable rate, the Guest acknowledges that the booking cannot be modified or cancelled, and the amount paid is not refundable in part or in full.
- Offers, Discounts
7.1. Current offers and discounts are advertised on the website.
7.1.1. The Service Provider’s package offers are exclusively bookable by individual Guests.
7.1.2. For corporate and group events, the Service Provider always prepares a unique, discounted offer for the Guest. In case of booking a service with special conditions, the Service Provider may establish terms stipulated in a contract.
7.2. Individual (package offers) or group (corporate events, weddings, etc.) discounts provided by the Service Provider cannot be combined with any other discounts.
Child Discounts
8.1. For children – when accommodated in the same room with parents – the following accommodation and meal discounts are provided:
- 0-5.99 years old: free of charge
- 6-11.99 years old: 40% discount from the current adult price
- Over 12 years old: adult price applies
- a) The child discount is available for a minimum of 2 nights and 2 adults booking, and when accommodated in the same room with parents.
b) For one adult and one child between 0-11.99 years old, we can provide single room accommodation with a child discount, subject to our available rooms (the number of our single, extra-bed-compatible rooms is limited). - c) Subject to available capacity, it is also possible to accommodate one adult and one child between 0-11.99 years old in a double room, the fee for which is 85% of the full package price (2 adults, min. 2 nights).
d) Accommodation for one adult and two children between 0-11.99 years old in our double rooms is provided upon payment of the full package price (which is equivalent to a 60% discount for two children aged 6-11.99).
e) 100% discounted accommodation for children under 6 years old is only valid when booking a package with two adults. In cases where only one parent travels with the child, points b) or c) mentioned above apply.
f) In a double room, alongside two adults (considering the characteristics of the available room), a maximum of three children can be accommodated at a discount according to the points mentioned above.
8.2. To claim the above discounts, a document proving the child’s age is required (address card, TAJ card, if available, ID card or passport). Without a document, the current full prices for accommodation, meals, and services will apply.
8.3. Extra beds can only be placed in certain room types. The Service Provider can provide a baby cot after prior arrangement, subject to availability. Requests for extra beds or baby cots must be arranged with the Service Provider in advance, at the time of booking.
Cancellation Policy
9.1. Unless the Service Provider has specified different conditions in its offer, the cancellation terms – except for force majeure situations defined in point 9.4 – are as follows prior to the original arrival date:
Please be informed that in case of booking cancellation, the Service Provider is entitled to apply the following penalty based on calendar days relative to the arrival date:
- between 14 and 8 days prior to arrival: 50% of the total payable amount;
- from 7 days prior to arrival: 100% of the total payable amount;
during peak periods:
- between 30 and 15 days prior to arrival: 50% of the total payable amount;
- from 14 days prior to arrival: 100% of the total payable amount.
For cancellations between 15 and 45 days prior to arrival (60-31 days during peak periods), the Service Provider does not apply a penalty, however, the paid booking fee is non-refundable. The Service Provider, at its discretion, may allow the booking to be rescheduled once to another date within the same price category, up to the amount of the paid sum, subject to available capacity.
If the Contracting Party is a business entity (including economic companies, social organizations, churches, municipalities, municipal institutions, state organizations and their institutions, etc.), the penalty due in case of withdrawal must be paid to the Service Provider by the Contracting Party/Client, even if the accommodation fee would otherwise be borne directly by the Guest acting on behalf of the client.
9.2. If the Contracting Party secured the use of accommodation services with a prepayment, and does not arrive on the arrival day (no written cancellation is received), the Service Provider will apply the full amount of the prepaid deposit as a penalty, as specified in the Contract. In this case, the accommodation will be held for the Contracting Party until 12:00 noon on the day following the arrival date, after which the Service Provider’s service obligation ceases.
9.3. If the Contracting Party has not secured the use of accommodation services with a prepayment, credit card guarantee, or other method stipulated in the Contract, the Service Provider’s service obligation ceases after 18:00 local time on the arrival day.
9.4. A Force Majeure situation is considered when the Parties cannot fulfill their contractual obligations due to unforeseen, compelling circumstances beyond their control at the time of contract conclusion.
9.4.1. Force Majeure includes any unforeseen natural obstacle (flood, fire, impassable road network caused by extreme snowfall) that makes it impossible to access or use the Service Provider’s accommodation or catering facilities. This also includes any currently valid legal regulation restricting or prohibiting travel, accommodation, or catering services (e.g., curfew), or other serious impeding factors (strike, war).
9.4.2. In case of Force Majeure, the general cancellation terms do not apply. Bookings already confirmed and maintained with a deposit can be utilized within 3 months after the cessation of the force majeure obstacle, subject to the accommodation’s current package offers and available capacity, at a new date agreed upon in writing between the Service Provider and the Guest.
9.5. Non-Refundable rates
The general cancellation terms specified in points 9.1–9.3 do not apply to bookings made at Non-Refundable rates.
A booking made at a Non-Refundable rate cannot be modified or cancelled, and in case of no-show, early departure, or cancellation for any reason, 100% of the amount paid is due to the Service Provider, which the Service Provider is entitled to retain as a penalty.
In case of force majeure, the provisions of point 9.4 of these GTC shall apply.
Payment Method, Guarantee
10.1. The ordered services can be paid for on-site with cash (in Forints), by bank card accepted by the Service Provider, SZÉP card, or by bank transfer, or by online payment. Somogy Kertje Üdülőfalu és Étterem reserves the right to request a payment guarantee or prepayment before the guest uses the ordered service, but no later than the guest’s arrival. Payment guarantee and prepayment can be pre-authorization with the guest’s bank card, or on-site payment for the ordered service upon arrival with cash or cash substitutes accepted by Somogy Kertje Üdülőfalu és Étterem, as well as a bank transfer equal to the value of the ordered service to the bank account of Somogy Kertje Üdülőfalu és Étterem before the commencement of the service.
10.2. In case of bank transfer – unless otherwise agreed with the Service Provider – the Guest is obliged to transfer the payment for the ordered services to the hotel’s bank account before the specified arrival day, in such a way that the amount is credited to the hotel’s bank account by the arrival day, or the Guest provides an irrevocable statement from their bank confirming the transfer.
10.3. Individual room bookings can be guaranteed by providing credit card details or by prepayment.
10.4. Other payment methods on-site: OTP Széchenyi Pihenőkártya, vouchers issued by the hotel and/or its contracted partners. When paying with a SZÉP card, to ensure legitimate card use, Somogy Kertje Üdülőfalu és Étterem may request advance payment for the ordered services and a public document suitable for identifying the Guest (ID card, driver’s license, or passport). The Guest is obliged to comply with the identification request. If identification fails for any reason beyond the control of Somogy Kertje Üdülőfalu és Étterem, Somogy Kertje Üdülőfalu és Étterem may refuse to accept payment by SZÉP card.
10.5. Detailed description of data required for credit card prepayment, payment process, and conditions
Bank cards issued exclusively for electronic use can only be accepted if their use is permitted by the issuing bank! Please inquire with your bank whether your card can be used for online purchases.
10.6. By accepting the General Terms and Conditions, the Guest acknowledges and agrees that the Service Provider will issue an invoice for the fees payable and for any amount paid by guests to the Service Provider on any legal basis.
10.7. Gift vouchers are considered accepted payment methods only upon prior notification and written confirmation from the Service Provider, and can only be used for the services specified on them or, in case of a special agreement, up to their value. Confirmed vouchers can only be accepted if their physical (printed) copy is presented upon check-in. Any other discount cards or coupons are only accepted if the intention to use them is indicated in advance (at the latest when booking accommodation or ordering in the restaurant). We do not redeem any vouchers, coupons, or discount cards for cash!
When issuing an invoice for amounts paid/to be paid, the Service Provider will base it on the data provided at the time of booking, or in the case of email, fax, or telephone bookings, on the data provided by the person making the booking.
The data provided here (name, address, tax number if necessary) will appear in the “Customer” field of the invoice. The Guest may request modification of the provided data within 1 day after the booking is made; however, modification is not possible after this period.
The Service Provider issues the final invoice based on the data provided at the time of booking.

Our goal is to address the reported observation and respond to you within 15 days of the notification.
Refusal of Contract Performance, Termination of Service Obligation
11.1. The Service Provider is entitled to terminate the accommodation service Contract with immediate effect, and thus refuse to provide services, if:
– the Guest uses the provided room or facility improperly;
– the Guest does not vacate their room by 10.00 on the day indicated as the departure day at check-in, and the Service Provider has not given prior consent for an extension of stay;
– the Guest behaves objectionably or rudely towards the accommodation’s security, order, or its employees, is under the influence of alcohol or drugs, or exhibits threatening, offensive, or otherwise unacceptable behavior;
– the Guest suffers from an infectious disease;
– the Contracting Party fails to fulfill its prepayment obligation specified in the Contract by the specified deadline;
